The Site is operated by Black Top Digital Assets LLC under the Cheetah Themes name (“Cheetah Themes,” “we,” “us,” or “our”).
Agreement To These Terms
Please read these Terms before using the Site or obtaining a product. By creating an account, placing an order, downloading a product where these Terms are presented to you, or otherwise using the Site, you agree to these Terms. If you do not agree, do not purchase or download a product or continue using the Site.
If you act for a business, organization, client, or other entity, you represent that you have authority to bind that entity to these Terms.

Eligibility And Accounts
You must be able to enter into a legally binding agreement under applicable law to create an account or purchase a paid product. The Site is not directed to children under 13.
Some features may require an account. You agree to submit accurate, current, and complete account, order, and contact information and to update it when necessary. You are responsible for safeguarding account credentials, download links, and license or activation credentials issued to you and for activity under your account, except to the extent applicable law provides otherwise.
We may suspend or restrict an account, order, download, or Site-provided service where we reasonably believe there has been fraud, unauthorized access, payment failure, abuse, material violation of these Terms, or a security risk.
Our Digital Products
Cheetah Themes offers downloadable digital products only. Products may include WordPress themes, child themes, plugins, bundles, documentation, and related digital resources. We do not sell or ship physical goods through the Site.
Products may be free or paid. Product descriptions, included files, technical requirements, compatibility information, license information, update availability, download access, and any included support will be described on the applicable product page, at checkout, in product documentation, or in a license provided with the product.
WordPress products are used in environments affected by WordPress versions, PHP versions, hosting, content, third-party themes or plugins, custom code, security settings, and other matters outside our control. You are responsible for reviewing product requirements, maintaining current website backups, using reasonable security practices, and testing installation or updates appropriately before use on a live website.
Orders, Pricing, And Payment
Your order is an offer to purchase the identified digital product on the terms presented to you at checkout. Paid orders are subject to our acceptance and successful payment processing.
The total charge presented before purchase will identify the price and any applicable tax or other charge collected through checkout. We may reject or cancel a transaction for suspected fraud or abuse, payment failure, pricing or technical error, legal restriction, or material violation of these Terms. If we cancel a paid order after payment has been successfully collected, we will issue an appropriate refund.
Payments are processed through PayPal or Square. Your use of a payment provider may be subject to that provider’s terms and privacy notice. Our collection and use of information, including payment-related transaction records we receive, are addressed in our Privacy and Cookie Policy.
We do not charge an automatically renewing subscription or renewal fee unless a product offer and checkout process clearly identify that recurring payment before you agree to it.
Download Delivery
Following successful payment processing for a paid digital product, download access is generally provided through the Site, an account area, an order-confirmation message, an email sent to the address you supplied, or another secure delivery method shown during checkout.
Free products may be provided directly through the Site, through an account or email-delivery process, or by another delivery method described on the relevant page.
Download access may be delayed if a payment is pending, a transaction requires fraud or error review, or a technical issue affects delivery. If you paid for a product and cannot access the correct download, contact support@cheetahthemes.com with your order information.
You are responsible for safely storing any product files you are entitled to retain, keeping credentials and download links secure, and installing or using products in accordance with the applicable license and documentation. Online access to prior versions, account downloads, or update services may change as stated in the applicable product offer or purchase terms.
Product Licenses And Your Opportunity To Review
Each downloadable product is provided subject to the license identified with that product. Before becoming obligated to pay for a paid licensed product, you will be provided access through the Site to the applicable license or purchase terms in a form that can be reviewed and retained. Product license terms will also be provided with the download or remain available electronically after purchase as applicable.
Some WordPress products or components may be made available under the GNU General Public License or another open-source license. The license delivered with or identified for a product governs your rights in its licensed files. These Terms do not take away rights expressly granted under an applicable open-source license.
Rights and benefits provided through the Site may be separate from rights in open-source code. For example, a paid purchase may provide access to paid downloads, account features, update delivery, license-key or activation services, or support for a stated period or under stated conditions.
If a standard-form license for a paid computer-information product is not made available for review before you become obligated to pay, any return or other right that applicable Virginia law provides is not limited by these Terms or by our money-back guarantee.
Free Products And Resources
We may provide free themes, child themes, plugins, documentation, articles, and other resources. We plan to make extensive self-help resources and how-to content available for free products.
Unless expressly stated on the applicable product page, free products do not include individualized technical support, custom development, guaranteed future updates, compatibility maintenance, or a particular service level. Because free products have no purchase price, there is no purchase payment to refund.
Paid Product Support
Paid products include support only as described on the applicable product page or in the purchase terms. Support may require reasonable information to verify the purchase, identify the product and version, and understand the issue.
Unless expressly included in the product offer, support does not include custom website design or development, custom functionality, hosting administration, third-party software repair, website content entry, website security management, or guaranteed compatibility with every environment, customization, or future third-party software version.
30-Day Money-Back Guarantee And Refunds
We offer a 30-day money-back guarantee for paid downloadable digital products purchased directly through the Site. You may request a refund for an eligible paid product within 30 calendar days after the original purchase date, whether or not you have downloaded it. You are not required to complete troubleshooting before making an eligible request.
To request a refund, email support@cheetahthemes.com within the 30-day period using the subject line “Refund Request” and include your order number or transaction identifier, if available, the name and email address used for the purchase, and the paid product for which you request a refund. We may request reasonable information needed to locate and authenticate the transaction, prevent fraud, or process the refund.
Approved refunds will be submitted to the original payment method unless another method is required by law or agreed by us. PayPal, Square, your card issuer, or your bank may require additional time to post a refund after we submit it.
The guarantee applies to paid Cheetah Themes digital products bought directly through the Site, including paid themes, child themes, plugins, and digital-product bundles. It does not apply to products obtained at no charge, a transaction already fully refunded, charges for third-party products or services not sold by Cheetah Themes, or purchases made from another marketplace, reseller, or seller.
When a paid purchase is refunded, access or services connected to that purchase may end, including paid-download access, paid account entitlements, update delivery, license-key or activation services, and paid support, to the extent provided as part of the refunded purchase. A refund does not revoke rights already granted under an applicable open-source license.
Nothing in these Terms limits a non-waivable refund, return, remedy, or consumer right provided by applicable law.
Accessibility
Cheetah Themes is committed to making the Site, purchase and download functions, product information, and support resources accessible and usable for people with disabilities. We aim to follow generally recognized accessibility practices, including the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA where reasonably practicable for the Site.
Accessibility is an ongoing effort. Third-party checkout tools, embedded content, or other services may have features outside our control. In addition, a website created using a Cheetah Themes product is affected by the customer’s content, configuration, color choices, plugins, customizations, hosting, and maintenance. Unless expressly stated otherwise, downloading or purchasing a product is not a guarantee that a completed customer website conforms to a particular accessibility standard or legal obligation.
If you have difficulty navigating, purchasing from, downloading from, or obtaining information from the Site, email support@cheetahthemes.com with “Accessibility” in the subject line. Identify the page, product, file, or feature involved and, if useful, your browser, device, and assistive technology. We will make reasonable efforts to address Site barriers or provide requested information or assistance through an alternative method where practicable.
Nothing in this Accessibility section is intended to limit any right or accommodation required under applicable law.
Site Content And Intellectual Property
The Site and its branding, trademarks, logos, original text, graphics, design, documentation, and other Site materials are owned by Cheetah Themes or its licensors and protected under applicable intellectual property laws, except for materials made available under an identified license.
Product rights are controlled by the product’s applicable license. Except as permitted by that license, applicable law, or our written permission, you may not reproduce, distribute, sell, scrape, frame, exploit, or create derivative works from Site content or Cheetah Themes branding. You may not use our name or marks in a way that suggests affiliation, sponsorship, endorsement, or origin without permission.
We make reasonable efforts to describe products and resources accurately. Features, compatibility information, pricing, documentation, offers, and product availability may be updated. We will not retroactively remove rights granted under an applicable product license or a non-waivable right under applicable law.
User Content And Feedback
If you submit reviews, comments, testimonials, screenshots, support attachments, feedback, bug reports, or other content (“User Content”), you represent that you have authority to submit it and that it does not violate applicable law or third-party rights.
You grant Cheetah Themes a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute User Content as reasonably necessary to operate the Site, provide requested support, address an issue, improve products or documentation, or promote our business, unless we separately agree otherwise in writing. You may ask that material provided in a support request not be used for promotional purposes.
Do not submit credentials, malware, confidential third-party data, infringing content, or content that is unlawful, deceptive, harassing, abusive, defamatory, or invasive of privacy. We may remove or refuse content at our discretion.
Ideas, feature suggestions, and other feedback may be used by us without restriction or compensation. Do not provide confidential or proprietary ideas unless covered by a separate written agreement.

We may send transactional communications about orders, accounts, downloads, refunds, support, security, product notices, or policy updates. Marketing communications, if offered, may be unsubscribed from through the method identified in the communication or by contacting us.
Third-Party Services

Limitation Of Liability
To the fullest extent permitted by applicable law, Cheetah Themes, Black Top Digital Assets LLC, and their owners, officers, employees, contractors, suppliers, licensors, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profit, revenue, data, business opportunity, goodwill, website availability, or business interruption, arising out of or related to the Site, a product, documentation, support, or these Terms.
To the fullest extent permitted by applicable law, our total liability for a claim arising out of or relating to the Site, these Terms, or a product will not exceed the greater of the amount you paid directly to Cheetah Themes for the product giving rise to the claim or $100.
Nothing in these Terms limits liability, statutory damages, or remedies that cannot be excluded or limited under applicable law.
Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Cheetah Themes, Black Top Digital Assets LLC, and their owners, officers, employees, contractors, suppliers, licensors, service providers, and affiliates from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or a product, your User Content, or your violation of these Terms, applicable law, or a third-party right.
Changes And Termination
We may modify, suspend, or discontinue Site features, future product availability, or resources at any time, subject to applicable law, applicable product licenses, and any express purchase terms.
We may update these Terms from time to time by posting an updated version with a revised “Last updated” date. Updated Terms apply to future Site use after posting and do not retroactively remove rights under an applicable product license or non-waivable law.
Termination or suspension of Site access does not alter rights you hold under an applicable open-source product license, but it may end Site-provided account access, restricted downloads, update delivery, paid support, or other paid services as permitted by applicable purchase terms.
Governing Law And Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise. Any dispute that is not subject to a mandatory forum under applicable law may be brought in a court of competent jurisdiction in Virginia.
Severability
If a provision of these Terms is found unenforceable, it will be interpreted or limited to the extent necessary to make it enforceable where permitted, and the remaining provisions will remain in effect.
